Nearby man files short-term injunction South Lake Tahoe cannabis permit approach on hold | South Lake Tahoe

SOUTH LAKE TAHOE, Calif. – There is yet another delay in cannabis corporations getting in a position to move forward in South Lake Tahoe.

Nearby business enterprise owner John Runnels filed a short-term injunction against the City of South Lake Tahoe, the City Council and the Improvement Solutions Director Kevin Fabino in Superior Court in Sacramento Friday afternoon. That action has place a short-term halt to all cannabis-associated permits getting processed in the city till a December 20 court date.

By way of his lawyer, former candidate for California Lawyer Basic and retired judge Steven Bailey, Runnels filed the court documents to “cease to approach applications for cannabis improvement permits such as but not restricted to issuing permits, reports or taking other actions that in furtherance of the issuance of improvement permit for cannabis improvement permits.”

Runnels was unsuccessful in his bid for one particular of the 3 retail sale licenses awarded by the City of South Lake Tahoe in June. Following a cannabis ordinance was made and criteria for applications created, the City received 21 applications for adult-use cannabis business enterprise, 18 of which have been for retail sales, two for microbusiness and one particular for cultivation:

Runnels and his business enterprise, The Green New Deal, came in final in scoring for the business enterprise that would have been operated out of the Runnels Automotive place at the intersection of Lake Tahoe Blvd. and Emerald Bay Rd. He attempted to file an appeal of the merits of the blind scoring approach along with South Tahoe Cannabis, Have A Heart, and MedMen. An outdoors lawyer came in to hear the appeals in a hearing and denied them. Runnels’ appeal was not accepted due to the fact of an incomplete application and non-payment of the necessary $323 appeal charge. He disagreed with the incompleteness of the appeal application and mentioned at the time he would most likely take legal action.

“At Friday’s hearing, the judge stated he necessary a lot more time to contemplate the merits of the plaintiff’s request for a short-term restraining order and the City’s demurrer, so he continued the hearings till December 20 and did not enable the parties to make an argument. In the meantime, he ordered the City to preserve the status quo, which he clarified to imply that the products planned to go on the City Council agenda on December three could not go forward. Sadly, the written order the judge signed seems substantially broader, so out of an abundance of caution, the City is not processing any cannabis-associated permits till we are in a position to get additional clarification from the court,” mentioned South Lake Tahoe City Lawyer Heather Stroud.

Through Thursday’s Arranging Commission meeting, a Retail Cannabis Use Permit and Improvement Agreement was unanimously authorized for Tahoe Green, as was a Microbusiness Cannabis Use Permit and Improvement Agreement for Fantastic Union SLT, LLC. These two have been headed to City Council for a initial reading vote on December three, but they are now delayed due to the short-term injunction, as Stroud mentioned.

Through their November five meeting, the Council authorized improvement agreements for Embarc Tahoe and Cannablue and their second reading was also planned for the December three meeting. They as well are now place on hold.

Redefining Organics has currently received its improvement agreement from the City and is now in the licensing approach at the state level.
